Financial Services (Jersey) Law 1998, as amended (FS(J)L)
The Jersey Financial Services Commission (JFSC) issues this public statement pursuant to Article 25(d) of the FS(J)L.
This statement is made in order to warn investors against dealing with unauthorised financial service providers and to advise the public of a website, www.smithandwilliamsonline.com (the Website) and the email addresses, info@smithandwilliamsonline.com and helpdesk@smithandwilliamsonline.com (the Email Addresses), which purport to represent Smith & Williamson International Limited.
Smith & Williamson International Limited is a genuine Jersey regulated business. However, the separate, unrelated entity purporting to represent Smith & Williamson International Limited through the use of the Website and Email addresses (the Scam smithandwilliamsonline), has not received authorisation to conduct financial services business within the meaning of the FS(J)L.
It appears that the Scam smithandwilliamsonline is carrying on, or holding out that it is carrying on, financial services business in Jersey when it is not authorised to do so pursuant to the provisions of the FS(J)L.
The JFSC wishes the following to be known:
1. The Scam smithandwilliamsonline, the Website and the Email Addresses are not connected in any way to Smith & Williamson International Limited or any other entity of the Smith & Williamson group.
2. The Scam smithandwilliamsonline has never been registered, nor applied for registration, under the FS(J)L. Therefore any financial services business, as defined in Article 3 of the FS(J)L and carried out by the Scam smithandwilliamsonline, is in breach of Article 9 of the FS(J)L.
3. From documentation held by the JFSC, it appears the Scam smithandwilliamsonline, the Website and the Email Addresses display warning signs of being set up for a fraudulent purpose.
All regulated businesses in Jersey are listed on our website.
Any person who has had dealings with the Scam smithandwilliamsonline is requested to contact the JFSC.
