Mr Andrew Crawford Norman Fleming (also known as Andrew Fleming, Andy Fleming, Andy Flemming, Crawford Fleming) ("Mr Fleming"), born: 30 October 1967

1 Action

1.1 The Jersey Financial Services Commission ("the Commission") issues this public statement under Article 25(a) of the FS(J)L with respect to directions issued to Mr Fleming under Article 23 of the FS(J)L.

1.2 This action supports the Commission’s objectives of reducing the risk to the public of financial loss and protecting and enhancing the reputation and integrity of Jersey in commercial and financial matters.

1.3 On 19 June 2015, Mr Fleming appeared before Jersey’s Royal Court and, having pleaded guilty, was convicted of one count of supplying the Commission with false and misleading information, contrary to Article 28(1) of the FS(J)L. Mr Fleming was sentenced to 12 months imprisonment. Further details of the offence can be found at http://www.jerseylaw.je/UJ/2015/JRC132.

1.4 Following Mr Fleming’s conviction, the Commission has deemed it necessary and proportionate to issue Mr Fleming with directions under Article 23(1) of the FS(J)L.

1.5 The directions prevent Mr Fleming performing any function for, engaging in any employment by, or holding any position in, any business licensed to conduct financial services business in Jersey. Issued: 22 December 2015 Page 2 of 2

1.6 The directions shall remain in force until such time Mr Fleming successfully applies to the Commission, pursuant to Article 23(6) of the FS(J)L, for a variance or withdrawal of the directions. Mr Fleming has also been issued with equivalent directions under the other regulatory laws¹.

1.7 Mr Fleming will commit an offence under Article 23(15) of the FS(J)L in the event he fails to comply with the provisions of the directions.

1.8 Pursuant to Article 23(15A) of the FS(J)L, any person who allows Mr Fleming to perform a function, engage in employment or hold a position knowing that such performance, engagement or holding is in contravention of the directions shall be guilty of an offence.
