Public Statement

› www.cvcgroups.com (the "Website")

Financial Services (Jersey) Law 1998, as amended (the "Financial Services Law")

The Jersey Financial Services Commission (the "Commission") issues this public statement under Article 25(d) of the Financial Services Law.

This statement is made in order to warn investors and others against dealing with unauthorised financial services providers. Private Capital has not received authorisation to conduct financial services business within the meaning of the Financial Services Law.

It appears to the Commission that Private Capital, as described on the Website, by using the words "CVC" and "CVC Groups" and by making unsolicited calls to potential investors in Europe, is falsely claiming to be connected to the CVC Capital Partners and CVC Credit Partners companies and funds formed in Jersey, including CVC Capital Partners Jersey Limited (together, "CVC Jersey"); bona fide registered financial services providers in Jersey.

The Commission wishes the following to be known:

1. Private Capital has never been registered, nor applied for registration, under the Financial Services Law. Therefore any financial services business, as defined in Article 2 of the Financial Services Law and carried out by Private Capital in or from within Jersey since 1 July 1999, is in breach of Article 7 of the Financial Services Law;

2. Private Capital is not connected in any way to CVC Jersey. CVC Jersey is authorised by the Commission to conduct regulated activities.

3. From documentation held by the Commission, it would appear that Private Capital and the Website displays warning signs of being set up for a fraudulent purpose.

All regulated businesses in Jersey are listed on our website.

Any person who has had dealings with Private Capital is requested to contact the Commission.
