Financial Services (Jersey) Law 1998 (FS(J)L)

Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 (Supervisory Bodies Law)

This statement is to warn members of the public against dealing with unauthorised financial service providers. The unauthorised entity has not received authorisation to conduct financial services business or Schedule 2 business in Jersey within the meaning of the FS(J)L and the Supervisory Bodies Law. 

From documentation held by the JFSC, the unauthorised entity is falsely claiming to be based in Jersey and registered by the JFSC.

The JFSC confirms the following:

  1. The unauthorised entity claims to be a Jersey incorporated entity.  This claim is false as the unauthorised entity has never been incorporated in Jersey.
  2. The unauthorised entity claims to be conducting regulated/supervised activities in Jersey.  The unauthorised entity has never been registered, nor applied for registration, under the FS(J)L or Supervisory Bodies Law. Therefore, any financial service business or Schedule 2 business carried on by the unauthorised entity, is in breach of Article 7 of the FS(J)L and Article 10 of the Supervisory Bodies Law.
  3. The unauthorised entity purports to be the investment manager for X Investment Products Tactical Credit Opportunities Fund Ltd, which it alleges is a Jersey structure.  There is no such fund or structure incorporated in Jersey.
  4. The unauthorised entity entity purports that SPV SR-71 (Jersey) Ltd is a Jersey-based ‘special purpose vehicle’ used by the unauthorised entity to facilitate investments.  There is no such entity or structure incorporated in Jersey.
  5. From documentation held by the JFSC, the unauthorised entity, the email address, the website, and the two alleged Jersey entities claimed to be connected to the unauthorised entity; X Investment Products Tactical Credit Opportunities Fund Ltd and SPV SR-71 (Jersey) Ltd, display warning signs of being set up for fraudulent purposes.  

Anyone who has had dealings with the unauthorised entity is asked to contact the JFSC’s Enforcement team.

Members of the public are able to verify (i) a company’s regulated status by visiting Regulated entities — Jersey Financial Services Commission and (ii) a company’s registration details by visiting Registry — Jersey Financial Services Commission.
