The Jersey Financial Services Commission (JFSC) issues this public statement under Article 25(d) of the FS(J)L.
This statement is to warn members of the public against dealing with unauthorised
financial service providers. The Impersonating Entity has not received authorisation to conduct investment business in Jersey and has no link to Bernd Franz Fröhler, a formerly registered legitimate financial services provider in Austria and The Netherlands.
From documentation held by the JFSC, the Impersonating Entity, via the Website, is falsely purporting to trade from Floor One, Liberation Station, St Helier, Jersey, JE2 3AS and is carrying on, or holding out that it is carrying on, investment business in Jersey when it is not authorised to do so pursuant to the provisions of the FS(J)L.
The JFSC wishes the following to be known:
- The Impersonating Entity, Website and Email Address are not connected in any way to the formerly registered legitimate financial services provider, Bernd Franz Fröhler, who operated from Weingartenweg 13, A-7035, Steinbrunn, Oostenrijk, Austria.
- The Impersonating Entity has never been registered, nor applied for registration, under the FS(J)L. Therefore any investment business, as defined in Article 2 of the FS(J)L and carried out by the impersonating entity, is in breach of Article 7 of the FS(J)L.
- From documentation held by the JFSC, the Impersonating Entity, Website and Email Address all display warning signs of being set up for fraudulent purposes.
Anyone who has had dealings with the Impersonating Entity is asked to contact the JFSC’s Enforcement team.
