Accessing the Obliged Entity Beneficial Owner register
As a leading international finance centre, we, along with the Government of Jersey and financial compliance professionals are committed to preventing money laundering and terrorist financing by following best practices set by international standard setting bodies such as the Financial Action Taskforce (FATF).
In March 2023, FATF recommended that member countries consider facilitating access to beneficial ownership information, to persons who are obliged to perform customer due diligence (CDD) to support them in this process.
Following legislative updates in Jersey, these obliged entities will be able to access certain personal information held by our Registry relating to beneficial owners and controllers of Jersey entities strictly for the purposes of fulfilling their CDD obligations pursuant to the Money Laundering (Jersey) Order 2008 (MLO).
Only certain permitted individuals within Jersey obliged entities and their representatives (accessing parties) will be permitted to access the Obliged Entity Beneficial Owner (OEBO) register through myJFSC.
From 24 February, the lead obliged entity administrator will be able to contact us to request their access.
Access to the OEBO register will be strictly controlled, and measures have been put in place to prevent misuse of the register.
We have published guidance detailing:
- an introduction to the legislation
- who can apply for access and how to apply
- role and responsibilities of the lead obliged entity administrator
- searching capabilities of the OEBO register
- regulation 4 and minors
- results on the register
- discrepancy reporting and markers
- the role of our Registry Supervision team in ensuring the register is used for legitimate purposes only
- data protection and subject access requests
