Register as a nominated person

The role of a nominated person

Every entity must have a nominated person. The nominated person is the main contact between your company and the Registry and is authorised to provide information and make submissions. A nominated person has access through our digital registry, myRegistry, to all the company's public and private information, including the details of the beneficial owners and controllers.

The nominated person will submit the annual confirmation statement, changes to associated parties and other applications.

An entity must appoint at least one nominated person, and can appoint more than one

Eligibility to be a nominated person

A nominated person must have a link to Jersey and must be:

  • a significant person of the entity (e.g. a director or secretary) who is resident in Jersey
  • a lawyer or account who is resident in Jersey and is carrying on business described in Part B of Schedule 2 to the Proceeds of Crime (Jersey) Law 1999
  • a Jersey registered trust company business providing secretarial or registered office address services
  • a Jersey registered funds services business

For example, you can be the nominated person if you are a director or company secretary resident in Jersey. If you are not eligible to be the nominated person, you must appoint someone who is.

Change of nominated person

A nominated person can resign by writing, either by letter or email, to the entity and to us.

If an entity wants to remove a nominated person, it can revoke the appointment of the nominated person by writing to us.

An entity should revoke the appointment of a nominated person if it becomes aware that the nominated person is not eligible, for example, if a director or secretary is the nominated person but they relocate and so are not resident in Jersey, then they are no longer eligible.

We also have the power to revoke the appointment of a nominated person, by writing to the entity, if the nominated person is not eligible.

Nominated person requirement

An entity must have a nominated person. If the only nominated person resigns or has its appointment revoked, the entity must appoint a replacement and notify us of the replacement. within 21 days.

It is a criminal offence if the entity does not appoint a nominated person or goes for more than 21 days with no nominated person and does not have a reasonable excuse.

The two-step nominated person registration process

Registering as a nominated person is a two-step process:

  1. Register as the nominated person (further detail on how to complete the form is below).

Once you have completed and submitted this form, the Registry team will review your application and generate an authorisation code that will be mailed to the registered office of your entity.

  2. On receipt of the authorisation code, the nominated person is required to log on and complete the registration process.

It is important that the person that you want to act as the nominated person completes the registration. This is because the authorisation code is unique to the company and the person that completes the registration form.

The process has been split into two steps to ensure that any private data held by the Registry is only accessed by an authorised person.
