The Jersey Financial Services Commission (the “Commission”) is aware of a recent press release made by the UK’s Financial Conduct Authority (the “FCA”) in relation to the EEA Life Settlements Fund (the “EEA Fund”).  A copy of this press release can be found on the FCA’s website at:

The Commission is also aware that members of the Jersey public have received advice to invest in the EEA Fund.  If you were advised to invest in the EEA Fund and would like to make a complaint, you should, in the first instance, write to the company that provided you with investment advice, setting out the reasons for your complaint.  If your complaint is not resolved to your satisfaction, you may then wish to escalate your complaint to the Commission.

The Commission treats all complaints very seriously and will consider whether they raise any regulatory concerns and whether they warrant regulatory action.  However, when considering lodging a complaint with the Commission, it must be recognised that, the Commission has not been given the role of an ombudsman.  Consequently, it is not able to adjudicate in disputes between complainants and registered persons.  More guidance on making a complaint can be found in the Commission’s Guidance Note: Complaints against Regulated Service Providers.
